This document sets forth the terms and conditions that apply to any purchases made on the thebehavioralcompass.com website (the “Site”) or any other sites owned by Behavioral Compass, LLC (the “Company,” “We,” or “Us”).   These Terms are in addition to the general Terms and Conditions and Privacy Policy, each of which are incorporated herein by this reference.

PLEASE REVIEW THIS DOCUMENT IN ITS ENTIRETY BEFORE ENTERING INTO ANY TRANSACTION TO CONFIRM YOUR ACCEPTANCE HEREOF. YOU MAY NOT ORDER OR OBTAIN PRODUCTS OR SERVICES FROM THIS SITE UNLESS AND UNTIL YOU: (A) AGREE TO THESE TERMS AND CONDITIONS IN THEIR ENTIRETY; (B) ARE AT LEAST 18 YEARS OLD; AND (C) ARE NOT PROHIBITED FROM ACCESSING OR USING THIS SITE OR ANY OF ITS CONTENTS, GOODS, OR SERVICES BY ANY APPLICABLE LAW, RULE, OR REGULATION.

1. Applicability.

These Terms of Purchase (these “Terms“) shall apply to your purchase of products and related services through the Site. These Terms are subject to change at any time without prior written notice by us. The most recent version of these Terms shall be posted for your review at any time on the Site. Please review these Terms in their entirety prior to engaging in any transaction on the Site. Your continued use of the Site after any posting of updated Terms (which shall be dated as of their most recent update) shall constitute your acceptance of and agreement to any changes therein made.

2. Products.

The items available for purchase on the Site include online courses, workshops, and other digital products, each of which are described below.

(a)  Courses and Workshops: Online courses and workshops may include: (i) access to in-depth video modules, resources, downloads, and homework to correspond to each lesson.  Purchase of a Course or workshop includes access to all Course Content.

(b) Programs and Membership:  

Subscription-Based Products/Services

We offer certain products and services on an automatic or subscription basis, so you can enjoy all the benefits of our products or services on a continuous basis. If you choose this option at the time of your purchase, you agree such products/services will automatically renew at the frequency disclosed to you at the time of your initial purchase (i.e., monthly basis). By choosing the automatic subscription option, you acknowledge and agree your subscription will automatically renew, and unless and until you cancel, you authorize us to charge your payment card for the products/services you continue to purchase. If you purchased a subscription with a free trial period, you authorize us to charge your payment card when the free trial period ends, unless you cancel your subscription before the free trial period ends, and you will not receive a notice from us that your free trial period has ended. The charges will typically occur on or around the same day of the month as your initial purchase, although some charges may be delayed for business or legal reasons. Your automatic subscription will continue until you or Behavioral Compass, LLC cancels your order. If there are any changes to your subscription terms, such as pricing, frequency, date of charge or any other items, we will take commercially reasonable efforts to inform you in writing of such change. You may modify or cancel your subscription at any time by emailing us at michael@thebehavioralcompass.com. Any modifications or cancellation of your subscription must be received by us at least three (3) days prior to the next scheduled payment date in order to take effect for that period. If you cancel less than three (3) days prior to the automatic renewal day for your subscription, your subscription will continue as scheduled and your cancellation will take effect in the following period.

3. General Terms.

When placing an order for a Course or Membership, you are effectively offering to purchase whatever products and services you select. We reserve the right to accept or reject any order in our own discretion. We will only accept or reject an order in its entirety. Should we elect to accept your offer, you will receive a confirming email at the email address that you provide at such time. Notwithstanding, we reserve the right to cancel any order once accepted by us (as evidenced by a confirming email) at any time in our sole discretion. Additionally, you have the option of cancelling your order as described in Section 5.

(a)  License Agreement.  For each Course purchased, subject to the limitations set forth herein, you are granted a revocable, non-exclusive, non-transferable, limited right and license to access all Course Content for your personal use. You may not share your login information with anyone, nor permit third parties to log in using your access credentials. We reserve the right to immediately terminate your license if you use the Course in a manner contrary to the terms set forth in this Section or in breach of any other of these Terms of the Terms of Service.  The Company retains all right, title and interest in and to the Course Content, including, but not limited to, all copyrights, trademarks, trade secrets, trade names, proprietary rights, patents, titles, computer codes, and all other rights whether registered or not and all applications thereof

4. Payment Terms.

(a)  For Courses, Workshops, and other Digital Content/For Subscription-based products and services: All applicable prices for Courses, workshops, consultations, supervision, etc. are as set forth on the Site. Your access to the materials will commence on the date of your initial transaction. Payment may only be made with a valid credit, debit card, or use of a bona-fide electronic payment provider (i.e., PayPal).  By using any such card or payment provider, you are hereby representing and warranting your full right and authority to make such purchase in the manner elected without violating any applicable law, rule, or regulation.

(b)   Promotional Pricing:  Prices for Courses listed on the Site may differ from the prices offered elsewhere (online or offline) by us for the same Courses. Such prices are subject to change at any time by us in our sole discretion.  Additionally, to the extent that we offer a promotion in connection with any particular Course, the terms of such offer shall be set forth in a separate document that shall govern its applicability (and, in the event of a conflict herewith, be considered the governing document). You will be responsible for the prices stated at the time of your purchase.

5. Refunds.

(a)  For Courses, Workshops, and Tutoring: All sales are final and non-transferrable, and the purchaser will have instant access to all course, product, and downloadable material, which cannot be returned. By using any resources provided by Behavioral Compass, you acknowledge that Behavioral Compass is in no way responsible for your passing the BCBA®/BCaBA® exam. Students acknowledge that they will receive tutoring paid by the hour, however their exam results may vary depending on factors such as independent time committed to preparation, etc. For this reason, you agree that NO REFUNDS SHALL BE PROVIDED regardless of your exam outcome. (b) For subscription-based products and services:

Upon cancellation of subscription or services you may be entitled to a partial refund by Behavioral Compass, LLC. The refundable amount will be determined based on the full price calculation for products/services and prorated for products/services already distributed.

6. Privacy Policy and Terms of Service:

Our Site Privacy Policy governs our processing of all personal information that we may collect from any person through the use of our Site. The Website Terms of Service governs your use of our Site in general, and also include important warranty disclaimers and limitations of liability which also apply to these Terms.
